1. Who we are
Top-Deck the Halls ("the Service") is operated by Top-Deck the Halls ("we", "us", "our"). You can reach us at support@topdeckthehalls.com.
These Terms apply to every visitor and registered user of the Service. If you are using the Service on behalf of an organization, you confirm you have authority to bind that organization to these Terms; if you are using it as an individual, you confirm you are of legal age to form a binding contract, or that a parent or guardian has agreed to these Terms on your behalf.
2. What the Service does
Top-Deck the Halls is a web tool for organizing in-person Commander Secret Santa deck exchanges. It lets an organizer set exchange rules, invite participants with a private link, collect card preferences, run a secret draw, and reveal pairings. It does not buy, sell, ship, or guarantee any cards or gifts; the gifts exchanged between participants are arranged entirely by those participants themselves.
3. Acceptance of these Terms
By creating an account, joining an exchange, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time; continued use of the Service after an update means you accept the updated Terms. Material changes will be posted on this page with a revised date.
4. Your account
You are responsible for keeping your sign-in credentials and magic-link emails confidential, and for all activity that happens under your account. You must provide accurate information (such as your name and email address) and keep it up to date. Notify us at support@topdeckthehalls.com if you believe your account has been compromised.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use it for any unlawful purpose, or in breach of these Terms;
- commit fraud, send spam, or phish other users;
- infringe anyone's intellectual property, including by uploading or linking to pirated card images or scans;
- interfere with the Service's security, including probing or scanning for vulnerabilities, introducing malware, or scraping the Service;
- harass other participants, or collect other users' personal information for purposes outside your own exchange;
- use another person's account, or provide false identity or contact details when joining an exchange.
6. Intellectual property
We own the Service, including its software, design, text, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose, within the limits of your plan. You may not reverse engineer the Service, resell or redistribute it, or circumvent its technical limits (such as participant caps).
You keep ownership of the content you submit, such as your display name, deck preferences, and decklist links. You grant us a limited licence to host and process that content solely to provide the Service to you and your exchange's participants.
Top-Deck the Halls is not affiliated with, endorsed by, or sponsored by Wizards of the Coast LLC. Magic: The Gathering and Commander are trademarks of their respective owners.
7. Service level
The Service is provided as-is and as-available. We do not guarantee that the Service will be uninterrupted, error-free, or that scheduled drawings will always run at the exact scheduled moment. We may modify, suspend, or discontinue any part of the Service at any time.
8. Warranties
To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Payment, fees and taxes
Organizing an exchange with up to 24 participants (including the organizer) is free. An optional one-time Large Exchange Upgrade costs $15 (USD) per exchange and raises that exchange's limit to 100 participants. See our Pricing page for details; the final price including any applicable tax is shown at checkout before you pay.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payments, billing, taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms: https://www.paddle.com/legal/checkout-buyer-terms. A paid upgrade applies to one specific exchange and does not renew.
10. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay fees due, create a security or fraud risk, or repeatedly or seriously violate our policies. Where practical, we will warn you first.
If your access ends, we may delete your account data after a reasonable window, except where we must keep it for legal reasons. Exchange organizers may cancel or delete an exchange at any time from within the Service.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill. Our total aggregate liability to you is capped at the fees you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability for fraud, death, or personal injury where that limit is not permitted by law.
You agree to indemnify us for claims arising from content you submit, unlawful use of the Service, or a breach of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of Colorado, USA, without regard to conflict-of-law rules. The courts of Colorado, USA have exclusive jurisdiction over any dispute arising out of these Terms, except where local law gives you the right to bring a claim in your home courts.
13. Other terms
You may not assign these Terms or transfer your account without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets. If any provision of these Terms is unenforceable, the rest remains in force. We are not liable for delays or failures to perform caused by events beyond our reasonable control (force majeure). These Terms are the entire agreement between you and us regarding the Service.
